Terms of Use

This Terms of Use (hereinafter referred to as the “Agreement”) outlines the terms and conditions for using the services (hereinafter referred to as the “Service”) provided on this website by Sharecite Health (hereinafter referred to as “the Company”). Users and providers of this Service (hereinafter collectively referred to as “Customers”) are expected to comply with this Agreement when using the Service.

Article 1 (Applicability)

This Agreement applies to all relationships between the Customers and the Company regarding the use of the Service.

In addition to this Agreement, the Company may establish various rules and provisions (hereinafter referred to as “Individual Provisions”) for the use of the Service. Regardless of their designation, these Individual Provisions form part of this Agreement.

If there is any conflict between the provisions of this Agreement and the Individual Provisions, the Individual Provisions shall prevail unless otherwise specified.

Article 2 (Sales Agreement)

A sales agreement is deemed established when a user applies for a purchase and the Company sends a notification of acceptance. For service providers, a sales agreement is established upon their notification of acceptance of service provision.

The Company may cancel the sales agreement without prior notice if any of the following applies to the Customer:

  • Violation of this Agreement
  • Any other situation where the Company deems that the trust relationship with the Customer has been compromised

The payment methods, delivery methods, cancellation, and termination procedures for purchase applications related to this Service shall be determined separately by the Company.

Article 3 (Intellectual Property Rights)

All rights, including copyrights, of product images and other content (hereinafter referred to as “Content”) provided by this Service belong to the Company or legitimate rights holders. Customers are not permitted to copy, reproduce, alter, or otherwise use this Content without authorization.

Article 4 (Prohibited Actions)

In using this Service, regardless of membership status, Customers must not engage in the following actions:

  • Violating laws or public order and morals
  • Engaging in criminal activities
  • Infringing on intellectual property rights such as copyrights and trademarks
  • Disrupting the Company’s servers or network functions
  • Commercially exploiting information obtained through the Service
  • Engaging in activities that may interfere with the operation of the Service (e.g., advertising, solicitation to other sites)
  • Attempting unauthorized access
  • Collecting or storing personal information of other users
  • Impersonating other users
  • Providing benefits to anti-social forces in connection with the Service
  • Any other actions deemed inappropriate by the Company

Article 5 (Service Suspension)

The Company may suspend or interrupt the provision of all or part of the Service without prior notice in any of the following cases:

  • Maintenance or updates of the Service’s computer system
  • Natural disasters or other force majeure events making it difficult to provide the Service
  • Unexpected issues, such as computer or communication line accidents
  • Other cases where the Company deems it difficult to provide the Service

The Company is not responsible for any disadvantages or damages incurred by Customers or third parties due to the suspension or interruption of the Service.

Article 6 (Usage Restrictions)

The Company may restrict the use of all or part of the Service for any of the following reasons without prior notice to the Customer:

  • Violation of any terms of this Agreement
  • Discovery of false information in registered personal information
  • Suspension of the credit card registered by the Customer
  • Non-payment of fees or other obligations
  • No response from the Customer for a specified period
  • No usage of the Service for a certain period after the last use
  • Any other cases where the Company deems the usage of the Service inappropriate

The Company assumes no responsibility for any damages incurred by the Customer due to actions taken under this Article.

Article 7 (Changes to Service)

The Company reserves the right to modify or discontinue the Service without prior notice to Customers and shall not be liable for any damages incurred by Customers due to such changes.

Article 8 (Changes to Terms of Use)

The Company reserves the right to change this Agreement at any time without prior notice if deemed necessary. If the Customer begins to use the Service after the changes, they will be deemed to have agreed to the revised Agreement.

Article 9 (Handling of Personal Information)

The Company shall appropriately handle personal information obtained through the use of the Service in accordance with the Company’s “Privacy Policy.”

Article 10 (Notifications or Communications)

Notifications or communications between the Customer and the Company shall be conducted by the method specified by the Company. Unless otherwise specified, notifications or communications sent to the current registered contact information will be considered to have reached the Customer upon transmission.

Article 11 (Prohibition of Assignment of Rights and Obligations)

Customers may not assign or pledge their position in the usage agreement or their rights or obligations under this Agreement to any third party without the prior written consent of the Company.

Article 12 (Governing Law and Jurisdiction)

The interpretation of this Agreement shall be governed by the laws of Japan. The United Nations Convention on Contracts for the International Sale of Goods shall not apply to this Service.

If any disputes arise regarding this Service, the court with jurisdiction over the location of the Company’s headquarters shall be the exclusive agreed-upon court of jurisdiction.
